Hungary guest worker permits: quota and employer obligations
Act XC of 2023 caps the Hungarian guest worker permit at three years with no permanent residence, under an annual government quota set by decree.
The guest worker permit is governed by Act XC of 2023 on the general rules for the entry and residence of third country nationals, together with the 2023 guest worker act, which replaced Act II of 2007 from 1 January 2024. It runs for a maximum of three years, two plus one, carries no path to permanent residence, and sits under an annual quota set by government decree.
The three gates before a worker is named
Hungarian guest worker recruitment is gated three times over, and each gate can close a plan that satisfies the other two.
The first gate is the quota. The government sets, by decree, the maximum number of third country nationals who may be employed in Hungary in a given year, and the Ministry for National Economy administers the figure. The quota is an annual ceiling on the whole country rather than an allocation an individual employer holds, so its practical effect is felt as a queue: applications filed late in a year run against a number that earlier filings have already drawn down.
The second gate is the list of eligible countries. Guest worker employment is available only to nationals of the countries named in the relevant decree, published through kormany.hu. The list is amended, and it is amended without regard to recruitment that is already under way. A sourcing plan built on a nationality that is removed at the turn of the year does not survive the amendment, and the workers already in Hungary on issued permits are treated separately from those whose files are still pending.
The third gate is on the employer side. Only employers that meet the conditions set in the decree may employ guest workers, and the categories include qualified employers and registered temporary work agencies. An employer that is not in an eligible category cannot file, and the qualification is assessed on the organisation, not on the vacancy. The employer registers before the recruitment rather than during it.
Duration, the labour market test and the procedure
Act XC of 2023 sets the maximum stay on the guest worker permit at three years, issued as two years with one further year on extension. The Act attaches no route from that status to permanent residence, and time spent as a guest worker does not build towards it. That is a deliberate design choice rather than an omission, and it is the single fact most often misstated to workers at the recruitment stage. An employer planning a long industrial ramp up should read the three years as a hard end date and plan the succession of the role, not the settlement of the worker.
A labour market test applies unless the job falls on an exempt list set by decree. Where it applies, the vacancy is tested before the permit is decided, and the employment must in every case be reported to the aliens policing authority, the National Directorate General for Aliens Policing, which decides the application and holds the register.

The costs of the file sit in an administrative service fee set by ministerial decree, and the decree is revised, so the figure should be taken from the version in force on the filing date. Consular filing and filing inside Hungary are priced differently, and the difference is large enough to matter across a cohort of thirty workers.
Accommodation, notification and the way files fail
Two employer duties survive the decision and are checked afterwards. The employer must arrange suitable accommodation for the guest worker or evidence that suitable accommodation exists, to the standard the legislation sets, and the employer must notify the authority when the employment ends.
Accommodation is where the file most often stalls before issue. The proof is a document about a specific property with a specific capacity, and employers who have secured beds only in principle by the time the application is due find the authority asks for the missing evidence and the application sits. Notification is where the file fails after issue. A worker leaves in June for a better paid post at another eligible employer, the old employer never notifies the National Directorate General for Aliens Policing, and the register continues to show an employment that ended. The consequence attaches to the employer, and it attaches at the moment the employer next needs the authority's goodwill, which is usually the following year's intake.
