Hungary guest worker residence permit: the employer's full procedure
Under Act XC of 2023 the Hungarian guest worker permit runs two years first, three years in total, and only a registered employer may apply for it.
The guest worker residence permit is the base title for employing third country manual workers in Hungary. Under section 31(1) of Act XC of 2023 (the Harmtv.) it is issued for a maximum of two years at first, and only an employer registered as a preferred employer or a qualified temporary work agency may apply for it.
Which employers may hire a guest worker
Section 30 of the Harmtv. opens a narrow gate. Not every company in Hungary may employ a guest worker: the law reserves that right for registered preferred employers and qualified temporary work agencies. The status has to be in place before the first labour demand, not at the moment the application is filed, and this is the most common structural blocker. An employer that has already selected its Nepali welders but is not on the register does not lose the application, it loses a full application cycle, because the status comes first and the immigration file only after.
The permit itself is issued by the National Directorate General for Aliens Policing. The office ties the permit to a named worker and a named job, so the subject of the application is not a headcount allowance but a specific person in a specific role at a specific place of work. That definition also decides what counts later as a reportable change.
The practical order is this:
- The employer obtains registration as a preferred employer or a qualified temporary work agency (Harmtv. section 30).
- The labour market and employment conditions for the role are documented, together with the employment contract and the accommodation certificate.
- The worker files the application at the Hungarian mission in the country of residence, or in Hungary in the cases the law lists, and the National Directorate General for Aliens Policing decides.
- After issue the worker travels in and starts work in the job named on the permit.
How long the permit runs, and where the ceiling sits
Two numbers belong at the front of the workforce plan. Under section 31(1) of the Harmtv. the guest worker residence permit is issued for a maximum of two years on first grant. Under section 31(2) it may be extended by one year at a time, but the total from first issue may not exceed three years. Three years is not a renewable threshold, it is the end of the title: once the third year runs out the worker does not stay in Hungary on this basis.
That ceiling dictates the shape of the plan. In a three shift plant where training takes six months, the end of year three is an automatic replacement unless the employer moves the worker onto another title in time. On cost, the administrative service fee is only the visible line. Beyond the application fee the employer carries accommodation, travel and document legalisation, and those items are usually several times the official fee. The current fee is published by the National Directorate General for Aliens Policing and is worth checking when the file is assembled, because it moves by decree.
Reporting duties and the family question
The employer's obligations do not stop when the permit is issued. Under section 31(9) of the Harmtv. a change in the employment conditions, including the job, the place of work and the worker's data, must be reported within five days. Five days is short in a plant where a supervisor moves a worker to another site and HR only sees it at the month end payroll run. This is the typical failure: the permit is not missing, the report is late, and a labour inspection does not read that difference in the employer's favour.
The second point belongs in the first conversation with the candidate. Under section 71(5) of the Harmtv. a guest worker may not bring family members on this title, and family reunification is excluded. If the candidate is planning around a spouse, the guest worker permit is not the right route, and that has to be said before the ticket is bought rather than after. A large share of early resignations traces back to this misunderstanding.
The quota is the third constraint, and it governs the timing of filing rather than the contents of the file. Its logic is set out in the Hungarian employment quota, and processing times sit side by side in the permit timeline by country.
The guest worker permit is a short, bounded, person specific title: two years, three in total, one named job, a registered employer, no family. An employer that puts those four elements at the front of the plan is not surprised by year three. An employer that does not gets the replacement exactly when the trained headcount is most expensive.
