Seasonal work permits for foreign workers in Croatia up to nine months
Article 104 of Croatia's Aliens Act allows a seasonal permit valid up to three years, with work of 90 days or nine months a year and no labour market test.
A permit for seasonal work is issued for up to three years, and the worker may work up to 90 days or up to nine months a year. The framework sits in Article 104 of the Aliens Act, published in Narodne novine 55/2026. For work of up to 90 days in tourism and agriculture, no labour market test runs.
Two lengths, two levels of scrutiny
The amendments were published on 27 May 2026 and entered into force on 4 June. The seasonal route is really two routes under one name. Work of up to 90 days in a calendar year in agriculture, forestry, hospitality and tourism is exempt from the labour market test under Croatian Employment Service guidance. Work beyond 90 days and up to nine months faces a shorter or a longer check depending on whether the occupation is on the shortage list for the competent police administration. If it is, the application runs through the Employment Service system without a test. If it is not, the test is carried out as described in the piece on the shortage occupation list by police administration.
The 2026 change is not the length of work but the length of the permit. One permit can now cover three consecutive seasons, so an employer bringing back the same people each year no longer opens the same procedure three times. A worker who has cleared the checks once returns the following year without a new permit, inside the annual limit of 90 days or nine months.

The deadlines that decide whether a worker arrives for the season
The Ministry of the Interior decides on a complete application within 90 days at the latest under Article 91(8) of the Aliens Act, with a further 30 days in justified cases. For an Adriatic season opening in late April, that means the file is lodged in January rather than in March. An application to renew a seasonal permit is filed at least 15 days before expiry under ministry guidance.
The volume is large enough for those deadlines to move the whole market. Ministry of the Interior figures for the first eleven months of 2025 record 19,467 seasonal permits inside a total of 160,176 residence and work permits. The Istria police administration issued 22,824 permits of all kinds that year and the Split and Dalmatia police administration 16,602, which shows where the seasonal pressure builds.
Accommodation, residence registration and cost
Seasonal housing follows the same rules as annual housing. The Regulation on the stay of third country nationals from Narodne novine 43/2026 requires at least 14 square metres for the first worker and a further 6 for each additional worker under Article 48, and caps rent at 30 percent of net pay under Article 49. The declaration of adequate accommodation on Form 17a is attached when a seasonal worker's residence is registered, under Article 77(4).
One deadline applies only to seasonal work and is broken regularly. Article 51 of the regulation requires a change of residence to be reported within three days of the change. An employer moving workers between buildings in Poreč and Rovinj through the summer has to report each move, and July is exactly when that is forgotten. State fees are known in advance. Under the ministry schedule, issuing a residence and work permit costs 74.32 euro, producing the biometric residence card costs 31.85 euro under the standard procedure, and issuing the document adds 9.29 euro.
Planning a season backwards
A seasonal schedule is built backwards from the opening date of the site rather than forwards from the day the HR team reaches the subject. From the opening date subtract the decision period of up to 90 days, the time for a visa and travel, and a week for residence registration and induction. Employers who use a three year permit for the same cohort do that calculation once rather than every year, and that is the largest practical change 2026 brought.
