Expired residence and work permit in Croatia: consequences
Croatia's Aliens Act requires a permit renewal at least 30 days before expiry. After expiry the worker stays illegally and gets 7 to 30 days to leave.
A residence and work permit renewal must be lodged at least 30 days before expiry. If the permit expires with no application lodged, the worker stays illegally from that day, must leave Croatia without delay and receives a return decision with 7 to 30 days to depart. The deadlines come from the Aliens Act (Narodne novine 133/2020).
The 30 day deadline and a decision before expiry
Article 92 of the Aliens Act requires the renewal application to be lodged at least 30 days before the current permit expires, at the police administration of the worker's place of residence. The deadline counts back from the expiry date printed on the permit, so the HR office should enter it in the calendar as soon as the worker collects the permit.
The same article obliges the Ministry of the Interior, through the police administration, to decide the application before the current permit expires. That is why the 30 days matter: they give the administration time to decide while the worker is still lawfully resident. No appeal lies against the renewal decision. The applicant may only bring an administrative dispute, which makes an error in the file more expensive than in a procedure with a second instance.
Permits issued under the previous text of the Act remain valid until their stated expiry date (Article 67 of the Act amending the Aliens Act, Narodne novine 55/2026). The amendments do not shorten existing permits, but every renewal after 4 June 2026 is lodged under the amended text.
The day after expiry: illegal stay and the return decision
The Aliens Act has no grace period after a permit expires. A third country national staying illegally must leave Croatia without delay (Article 183, paragraph 2). The police administration issues a return decision, and Article 184 sets a voluntary departure period of at least 7 and at most 30 days, counted from delivery of the decision.
If the stay continues and the person is expelled for illegal stay, the expulsion carries an entry ban for the European Economic Area and Switzerland of 3 months to 5 years (Article 192, paragraphs 6 and 9). For the employer, a worker it hired and trained cannot be employed again in Croatia or in any other state of that area while the ban runs.
Employer duties since 4 June 2026
The Act amending the Aliens Act was published in Narodne novine 55/2026 on 27 May 2026 and entered into force on the eighth day after publication, 4 June 2026 (Article 70). Two amendments bear directly on an expired permit.
The first concerns enforcement. When police find a worker working without a permit, they charge the worker and notify the inspectorate (Article 240, paragraph 4). That notice opens an inspection of the employer, covered in the guide to the EU Employer Sanctions Directive and illegal employment.
The second concerns the end of employment. Since 4 June 2026 only the employer must notify police when the employment contract ends (Article 95, paragraph 1, as amended). If the worker does not renew and the contract ends, the report rests with the employer alone.

The practical sequence for an employer: record each permit's expiry date on collection, prepare the application early enough to lodge it before the 30 day line, and report every contract end to the police without exception.
