Truck driver pay deductions and stay clauses in Spain
Under Estatuto de los Trabajadores article 21.4, a Spanish carrier may bind a driver for at most two years, in writing, and only for specialised training it paid.
A Spanish carrier may tie a driver to the company for at most two years, only in writing and only where it paid for specialised training for a specific job (Estatuto de los Trabajadores article 21.4). If the driver leaves early, the carrier claims damages. It may not simply deduct the debt from wages.
The failure mode: a verbal clause and a wage deduction
The most common breach starts with an informal promise. A carrier recruits third country drivers, pays for their professional training, and agrees with them orally that they will stay for a period. When a driver resigns, the carrier withholds part of the final pay to recover the training cost.
Two rules fail at once. First, article 21.4 requires the stay agreement to be in writing, so a verbal clause gives the carrier no enforceable commitment. Second, even a valid written clause does not authorise a deduction: the remedy for early departure is a claim for damages. A deduction that takes cash pay below the floor can then be treated by the labour inspectorate as payment below the minimum wage, which the Government sets each year and whose monthly amount cannot be garnished (article 27).
What a valid stay clause requires
Article 21.4 sets narrow conditions. The employer must have paid for specialised professional training, and that training must have been given for a specific project or job. General induction, routine instruction or costs the worker would carry in any job do not qualify. The clause then has two fixed limits: a maximum of two years and written form.
| Condition | Rule | Provision |
|---|---|---|
| Who paid the training | the employer | Article 21.4 |
| Type of training | specialised professional training for a specific project or job | Article 21.4 |
| Maximum duration | two years | Article 21.4 |
| Form | always in writing | Article 21.4 |
| Remedy if the worker leaves early | claim for damages | Article 21.4 |
For a carrier recruiting abroad, the practical point is timing. The written clause should be signed before the training starts, and it should state the training, its cost and the period of the commitment. A driver whose licence must first be recognised in Spain adds a further step to the calendar, covered in our guide to the Spanish driving licence exchange for non EU workers.
Housing, meals and expenses on the payslip
Carriers often provide accommodation to drivers arriving from outside the EU. Article 26.1 allows part of salary to be paid in kind, but pay in kind may not exceed 30 percent of the worker's salary and may never reduce the cash minimum wage. Housing valued above that share, or housing charged so that cash pay falls under the minimum, breaks the rule.
Expenses follow a separate logic. Under article 26.2, amounts that reimburse expenses the worker incurred for the job, such as travel allowances on the road, are not salary. A carrier cannot count them when checking that a driver earns at least the minimum. Payroll that blends allowances into the base to reach the floor is the pattern inspectors look for.
Working time records in the same file
Pay and hours are reviewed together. Article 34.1 caps ordinary working time at 40 hours a week of effective work, averaged over the year. Article 34.3 requires at least 12 hours between the end of one working day and the start of the next, and caps ordinary hours at nine a day unless agreed otherwise. A carrier whose records show short rest periods for newly hired drivers faces the working time finding alongside any pay finding.
Checklist before the first trip
- A written stay agreement, signed before training, naming the specialised training and a period of no more than two years.
- No clause allowing training costs to be deducted from wages on departure.
- Pay in kind, including housing, valued at no more than 30 percent of salary, with cash pay at or above the minimum wage.
- Expense reimbursements shown separately from salary.
- Working time records showing the 40 hour average week and 12 hours of daily rest.
Breaches in the file of a foreign worker sit within the wider EU framework on employer obligations, described in our note on EU employer sanctions for illegal employment.
