Out of quota entries in Italy: the article 27 categories
Article 27 of Legislative Decree 286/1998 lists 18 categories of workers who enter Italy outside the decreto flussi quotas, from managers to registered nurses.
Not every work entry into Italy runs through the decreto flussi. Article 27 paragraph 1 of Legislative Decree 286/1998 lists eighteen categories, from letter a) to letter r-bis), that enter outside the annual quotas. For these positions the nulla osta is requested from the Sportello Unico per l'Immigrazione at any point in the year, with no click day and no competition against other applications.
The categories an employer actually meets
The article 27 list is long and includes rare entries, such as performing artists or airline staff. In the practice of a company hiring from abroad only a few of them recur.
Letter a) covers managers and highly specialised personnel of companies with a seat or a branch in Italy, or of representative offices of foreign companies. This is the classic intra group transfer route, and it assumes a pre existing relationship with the group.
Letter i) covers employees of foreign employers posted temporarily to Italy to carry out work under a contract for services. It is the entry that matters to construction and plant engineering firms bringing their own crews onto an Italian site, and it has to be read together with the posting rules, because an out of quota entry does not suspend the pay and safety duties owed to a posted worker.
Letter q-bis) was added for digital nomads and highly qualified remote workers employed by a foreign employer while residing in Italy.
Letter r-bis) opens out of quota entry to registered nurses recruited by public and private healthcare providers. It is the legislative answer to the nursing shortage and it concerns hospitals, clinics and care homes directly.
The procedure, the eight day deadline and the cost
The nulla osta is requested electronically from the Sportello Unico per l'Immigrazione at the prefecture covering the workplace. The office checks that the category claimed is made out, obtains the opinion of the Questura and forwards the nulla osta to the Italian diplomatic mission in the country of origin, which issues the entry visa.
One follow up duty is regularly missed. For entries under letters a), c) and i-bis) of article 27 of Legislative Decree 286/1998, the employment contract must be sent to the Sportello Unico within eight days of the worker's entry into Italy. Eight days is short when the person lands on a Friday and the file sits with a group office abroad.

The costs follow the ordinary regime. The residence permit contribution is 100 euro for permits valid for more than one year and up to two years, plus the 16 euro stamp duty and the 30,46 euro postal kit. The full work and residence permit procedure sets out each step.
Where the application stalls
The most frequent refusal turns on classification rather than on merit. A company files under letter a) for a person whose documents describe a line technician, with no pay level, job grade or training history to support high specialisation. The Sportello Unico reclassifies the role as ordinary subordinate employment, which is quota bound, and the application lands outside any usable click day.
The second stall concerns letter i). The posting has to rest on a genuine contract for services between two companies, with an identified Italian client and a defined scope of work. Where the arrangement looks like the supply of labour, the office does not accept it as a posting and the out of quota entry falls away.
The third is housing. Even outside the quota the employer must provide suitable accommodation, and the housing suitability certificate comes from the municipality on its own timetable, which has to be started before the visa rather than after it. The detail sits in the residence contract and housing suitability certificate.
For anyone planning foreign hiring into Italy, article 27 should be read before the decreto flussi quotas for 2026 to 2028. If the role fits one of the eighteen letters, the quota calendar stops mattering and entry timing depends only on how complete the file is.
