EU Blue Card in Hungary: duration, conditions, employer steps
Section 37 of Hungary's Act XC of 2023 caps the EU Blue Card at four years, renewable in four year terms, and it sits outside the employment quota.
The EU Blue Card is Hungary's route for highly qualified third country workers. Under Section 37 subsection (5) of Act XC of 2023 it can be issued for a maximum of four years and renewed in four year terms. The National Directorate General for Aliens Policing issues it, and it sits outside the employment quota.
Validity: two years from below, four years from above
The Act fixes two numbers. Under Section 37 subsection (4), the Blue Card runs for at least two years, or, where the employment contract is shorter, for the term of that contract up to two years. Under Section 37 subsection (5), it can be issued for at most four years and renewed in four year terms.
The consequence shows up at contract stage. An eighteen month fixed term contract produces an eighteen month Blue Card, not a two year one, so the renewal falls in the middle of the project. The same role on a four year contract is covered by a single procedure. The employer decides, through the length of the contract, how many times it runs the immigration file.
Renewal is not automatic. The same conditions are evidenced again, and the National Directorate General for Aliens Policing examines an application filed before the current card expires. An employer that times the filing for the week of expiry risks a break in lawful employment.
Why it stays open when the quota is exhausted
The Hungarian rules transpose Directive (EU) 2021/1883 on the entry and residence of third country nationals for the purpose of highly qualified employment. The directive adds two things the national guest worker titles do not carry: intra EU mobility, meaning a regulated path into a second member state, and a more favourable family reunification regime.
For workforce planning the decisive point is elsewhere. The Blue Card does not fall under the employment quota. Once the quota set for the year is exhausted, new applications on quota bound titles stop, while the Blue Card stays open for roles that meet the highly qualified conditions. For an engineering or IT position that means hiring does not halt in the middle of the calendar year.

What the employer assembles before filing
The order runs as follows. First, match the role to the qualification: the Blue Card is for highly qualified employment, so the degree or the recognised professional experience has to fit the position. Second, the employment contract, whose length sets the validity directly under Section 37 subsections (4) and (5). Third, evidence of the salary condition, which Hungary sets on the basis of the directive. Finally, the application to the National Directorate General for Aliens Policing, with the contract, the qualification documents and the accommodation details.
Directive 2021/1883 ties the salary condition to average earnings in the member state, so the Hungarian threshold tracks a moving figure and has to be read again every year. It matters most at renewal: a contract salary that sat a few percent above the threshold at filing can fall below the following year's figure, and the renewal then fails on pay rather than on the worker. The defence is to set the pay band against the threshold rather than against the internal salary table, and to hold that gap for the whole term of the contract.
The recurring failure is an employer treating the Blue Card as a simple substitute for the national guest worker titles and filing it for a manual role. The application then stalls not because the file is incomplete but because the role is not highly qualified employment. The second failure is qualification recognition: a foreign degree on its own is not enough where the role belongs to a regulated profession.
