France talent residence permit for qualified employees and its salary threshold

Loi n° 2024-42 of 26 January 2024 renamed the passeport talent as the talent permit. The label changed, the logic did not. The permit removes the labour market examination for the employer, which makes it the fastest route for a management or engineering profile.
The conditions in article L. 421-9 of the CESEDA
The permit requires a qualification at least equivalent to a master's degree, or recruitment by a recognised innovative young company. The contract is concluded with an employer established in France, permanent or fixed term, and the gross annual pay must reach the threshold set by decree.
The most significant change for employers is the nature of that threshold. It used to be indexed to twice the annual gross SMIC, and so moved with every minimum wage revaluation. The arrêté of 21 August 2025, published in the Journal officiel of 31 August 2025, repealed the two 2016 orders that carried the old amounts and substituted a reference gross average annual salary, set at 39,582 euros against 35,891 euros before. The threshold no longer follows the SMIC mechanically, which means checking the figure in force at the time of filing rather than recalculating it.

The table shows where the decision sits. An engineer recruited at 45,000 euros belongs under the talent qualified employee route rather than the EU Blue Card, whose threshold is far higher. A technician recruited at 32,000 euros falls under neither and goes through the ordinary work authorisation, with the labour market examination that implies, described in the introduction procedure for a foreign employee.
What the permit changes for the employer
Three practical effects justify the work of qualifying the file.
The first is that the employment situation cannot be raised. The employer does not have to advertise the vacancy with the public employment service for three weeks or evidence the absence of suitable applications. Removing that step saves about a month on the mobilisation calendar.
The second is duration. Four years cover an industrial project or a software rollout without an intermediate renewal, where a one year salarié permit sends the worker back to the prefecture every year, with the waiting period that visit implies.
The third concerns the family. The spouse and minor children receive a permit marked talent famille, issued as of right and allowing the spouse to work, which weighs on a decision to accept a posting abroad as much as the salary itself.
Where these files become fragile
The pay taken into account is the contractual gross annual salary. Variable bonuses, benefits in kind and expense reimbursements are not counted the same way as fixed pay, and a contract that reaches the threshold through a discretionary bonus is a contract that does not reach it in the eyes of the examining service. An employer aiming at exactly 39,582 euros builds the file on the line; an employer writing a few thousand euros of margin into the contract avoids a request for further documents.
The second point is diploma equivalence. A master's degree obtained in Kathmandu, Bangalore or Manila has to be presented in a form the French administration can read, with a sworn translation and, where the academic path is unusual, a comparability statement. That file is prepared weeks before submission, not during examination.
