Spain arraigo socioformativo: deadlines and 30 hour cap
Article 127.d of Royal Decree 1155/2024 extinguishes the arraigo socioformativo if enrolment is not proven within three months; article 131.b caps work at 30 hours.
An arraigo socioformativo holder may work as an employee for up to 30 hours a week, under article 131.b of Royal Decree 1155/2024. The larger risk for the employer is elsewhere: if the worker does not file proof of enrolment at the immigration office within three months of notification of the grant, the authorisation is extinguished and the contract loses its basis.
The failure that costs the hire: enrolment within three months
The immigration regulation, in force since 20 May 2025, keeps the former training arraigo (arraigo para la formación) under the new name arraigo socioformativo. It is one of five arraigo types in article 125.1, alongside second chance, sociolaboral, social and familiar.
Article 127.d requires the applicant to be enrolled in, or studying, a course covered by articles 52.1.b or 52.1.e 5.º, including compulsory secondary education for adults. Where enrolment has an official period, the application is filed in the two months before that period opens. Once the permit is granted, the holder has three months from notification to file proof of enrolment at the immigration office. If that does not happen, the authorisation is extinguished.
The same consequence applies to the second route in the article: a commitment to complete Public Employment Service training for occupations on the article 75.1 shortage catalogue. If that training is not completed, the authorisation is also extinguished. An HR team hiring a holder should ask for a copy of the enrolment and record the deadline in the personnel file from the first day.
The file calendar, with deadlines
| Stage | Deadline | Basis |
|---|---|---|
| Prior presence in Spain | 2 years, continuous | Art. 126.b |
| Filing, where enrolment has an official period | 2 months before it opens | Art. 127.d |
| Social integration report | 1 month from the request | Art. 127.c and 127.d |
| Correction of an incomplete file | 15 days at most | Art. 130 |
| TIE identity card application | 1 month from notification | Art. 130.6 |
| Proof of enrolment | 3 months from notification | Art. 127.d |
| Permit validity | 1 year | Art. 125.2 |
| Extension | 2 months before expiry | Art. 132.3 |
The application is filed in person and needs no visa. If documents are missing, the office issues a correction request with a deadline of at most 15 days and archives the file if it is not answered. Time spent as an international protection applicant, until a final decision, does not count towards the two years of presence. The applicant also needs a clean criminal record in Spain and in the countries of residence during the five years before entering Spain, and a favourable social integration report from the regional authority.
Conditions of the employment contract
Article 131.b allows employed work only, capped at 30 hours a week across all contracts. Pay may not fall below the minimum wage or the collective agreement rate, pro rata to the hours worked. The other arraigo permits carry authorisation for employed or self employed work with no geographic or occupational limit. Under socioformativo, the employer should therefore check that the combined contracts stay within 30 hours.
| Point | Arraigo socioformativo | Other arraigo permits |
|---|---|---|
| Type of work | Employed only | Employed or self employed |
| Hours | 30 a week at most | No specific cap |
| Scope | Subject to the hours cap | No geographic or occupational limit |
| Duration | 1 year | 1 year (5 years for familiar) |
Extending hours beyond 30, or adding a second contract that takes the total above that figure, puts the worker outside the conditions of the permit.
Extension is not automatic
To extend, the training centre must issue a report certifying promotion to the second year for basic or intermediate vocational cycles, under article 132.2.b. If the training ends within the year, the holder files the diploma or certificate and proves active job search with registration at the public employment service.
The extension is filed in the two months before expiry. Filed within the three months after expiry, validity is still extended, but the holder is exposed to a sanction under article 52.b of Organic Law 4/2000.
