Renewing a Greek residence permit for work and what gets checked

A renewal of a residence permit for work is filed under article 11 of Law 5038/2023 with the Directorate for Aliens and Migration. The office checks whether tax obligations were met and whether insurance capacity stayed active during the previous permit. The state fee is 150 euro and the worker pays it.
Which law applies and since when
The Migration Code, Law 5038/2023, was published in Government Gazette A' 81 of 1 April 2023 and came into full application on 31 March 2024, as the Ministry of Migration and Asylum records. Permits issued under the earlier Law 4251/2014 are now renewed under the rules of the new Code.
Article 11 governs the filing of the renewal application. The application is submitted while the previous permit is still in force. A worker who lets the permit lapse before filing is not running late, he is outside lawful residence, and that affects the employment contract and his insurance at the same time.
For the dependent and seasonal employment categories E.1 to E.5, Law 5038/2023 and circular 95391 of 20 March 2024 tie the permit to an employment approval procedure. What the office checks and what the worker pays
The renewal review looks backwards, not forwards. The Directorate for Aliens and Migration examines, under Law 5038/2023, whether the holder met his tax obligations and kept active insurance capacity while the previous permit was valid. A worker with months of missing contributions, because the employer filed late or stopped paying, arrives at renewal with a gap he did not create.

What this means for the employer
Formally the renewal belongs to the worker. In practice the employer holds the two proofs that decide the outcome. Contributions and declared insurance days come from his own filings with e-EFKA. If the history has gaps, the renewal file shows them immediately. A timeline that works in practice starts four months before expiry. Month one, collect the tax clearance and the insurance history certificate. Month two, look for gaps and correct them while there is still time. Month three, pay the 150 euro fee and file. Month four is the margin for anything the office asks for in addition. Filing in the last week of validity removes every chance of correction.
The filing certificate issued with the application allows lawful residence and work to continue until the file is decided. The employer should keep a copy of it in the worker's file, because in an inspection it is what explains why the residence card looks expired while the worker is lawfully at his post.
