EU Fair Labour Mobility Package: what employers face
The European Commission proposed the Fair Labour Mobility package on 15 September 2026: five proposals, a digital A1 under ESSPASS and faster recognition.
The European Commission adopted the Fair Labour Mobility package on 15 September 2026: one Communication and five legislative proposals. None is law yet. Each takes effect only after adoption by the European Parliament and the Council, and the digital A1 under ESSPASS follows one year after its regulation enters into force. Paper A1 procedures apply until then.
The failure mode: planning 2027 postings on a digital A1
An employer posting staff in 2027 that counts on a digital A1 under ESSPASS will find no such document. The A1 goes digital only one year after the ESSPASS Regulation enters into force, and the regulation first needs adoption by the European Parliament and the Council. Until that sequence completes, the current A1 procedures and deadlines of each national social security institution apply. The existing rules are covered in our note on the A1 rules reform of Regulation 883/2004.
The five proposals and what each would change for employers
| Proposal | What it would do | Employer relevance |
|---|---|---|
| ESSPASS Regulation | Lets people request and receive social security documents online, including the A1 and the EHIC | Posting files, A1 requests |
| Skills Portability Act | Simpler recognition of non EU qualifications | Hiring third country nationals |
| ELA Regulation | Widens the European Labour Authority mandate to abuse of third country workers and illegal employment, with inspection risk assessments | Inspection exposure |
| Directive amending the professional qualifications rules | Digital qualifications and changes for regulated professions | Nurses, engineers and other regulated roles |
| Directive on qualifications of third country nationals | Common standards for recognising non EU qualifications | Recruitment lead times |
The Commission estimates EUR 5 billion in benefits by 2040, including EUR 1 billion in simplification gains. Member states keep full control over admission to their territory and over the standards to practise a profession, so national work permit procedures stay as they are.
The timeline after adoption
Every date in the package runs from adoption or entry into force, not from the calendar. An employer cannot place any of these dates in a 2027 plan until the Parliament and the Council have adopted the texts.
| Measure | When it would apply |
|---|---|
| Digital A1 under ESSPASS | One year after the ESSPASS Regulation enters into force |
| EHIC and other social security documents online | Within three years |
| Simpler recognition of non EU qualifications | Within two years of adoption |
| Digital qualifications and regulated profession changes | Within three years of adoption |
| ELA improvements under the revised mandate | Expected over 2028 to 2030, once adopted |
Recognition: the change with the largest effect on lead times
Recognition of non EU qualifications averages 14 months today. The Commission says common standards would cut this to 4 months. For regulated professions such as nurses and engineers, a mandatory digital procedure would shorten recognition from three months to five weeks.
For seven professions with EU training standards, qualifications from accredited non EU institutions reviewed by European bodies would be recognised automatically. An employer recruiting nurses from outside the EU would see a shorter time between offer and start, but only once the relevant directive applies.
What an employer should do now
Keep current A1 practice for every posting planned for 2027, and budget the current recognition times for regulated roles. Track the adoption of the ESSPASS Regulation, because its entry into force starts the one year count for the digital A1. Review inspection readiness for third country staff, since the ELA mandate is set to widen. Postings of non EU staff are covered in our guide to posting non EU workers between EU countries.
